Questions people ask
- What is the late fee for GSTR-3B or GSTR-1?
- ₹50 a day (₹25 CGST plus ₹25 SGST) for a regular return and ₹20 a day for a nil return, under Section 47 of the CGST Act as reduced by notifications. The same daily rate applies to GSTR-1 and GSTR-3B.
- What is the maximum late fee?
- It depends on turnover in the previous financial year. For a regular return the cap is ₹2,000 up to ₹1.5 crore, ₹5,000 from ₹1.5 crore to ₹5 crore, and ₹10,000 above ₹5 crore. A nil return is capped at ₹500.
- From which day is the late fee counted?
- From the day after the due date until the day you file. Filing on the due date costs nothing.
- Is interest charged on top of the late fee?
- Interest is separate and applies to tax that was paid late, at 18% a year on the net cash tax. Use the GST interest calculator for that.
- Can I pay the late fee from input tax credit?
- No. Reports say the late fee has to be paid in cash from the electronic cash ledger.
- What if the due date was extended?
- Enter the extended date from the notification as the due date. The calculator uses whatever date you give it.
